Did you know anything you publish online that could be considered promotional communications is subject to advertising codes of practice? This can cover content posted on social media, websites and in email marketing.


There’s a lot of confusion about the rules and how they affect working with influencers in particular, especially around what they can and cannot say if their posts promote any products, services, events or promotions on your behalf.

It’s serious business – the Code is enforced by the Advertising Standards Authority (ASA), who can remove any adverts that breach the rules.

When one of my clients partners with an influencer, I make sure the influencer is aware of all the relevant rules around how adverts should be clearly recognisable as adverts, and how they can avoid misleading people. It sounds scary, but really, it can be as straightforward as including a carefully-worded statement alongside their content if they have any kind of commercial relationship with a brand.

There are also rules around advertising certain types of products to specific audiences, and running competitions – my years of running promotions means I'm well versed in understanding the lingo used in terms and conditions!
